改正された労働者派遣法

◆労働者派進法改正の実施は10月
「労働者派遣事業の適正な運営の確保及び派遣労働者の就業条件の整備等の関する法律案｣が成立しましたが、施行日は6ケ月以内の政令で定める日とされ今年の10月から施行される予定です。派遣法のどこが変わったのでしょうか。
①日雇い派遣の原則禁止
専門26業種や雇用機会の確保が特に困難と認められる労働者の雇用継続をはかる為に必要と認められる場合を除き、日雇労働者の派遣が禁止されました。日雇い派遣は日々又は30日以内の期間を定めて雇用する派遣労働者の禁止が定められています。例外として「ソフトウエア開発」「通訳」「翻訳」「速記｣等、特定の業種は禁止されていません。
②グループ企業派遣の規制
同一グループ内の企業に労働者派遣が出来る割合は8割以内に制限されました。また、離職した労働者を離職後1年以内に労働者派遣として受け入れる事を禁止され、法改正によりグループ企業内の派遣には一層規制が強化されました。
③偽装請負など違法派遣に対する対処
派遣事業主が労働者派遣に関して違法な派遣行為である事を認識していて派遣労働者を受け入れている場合、派遣先事業主が派遣労働者に対して労働契約を申し込んだものとみなす「労働契約申し込みみなし制度」は今回見送られ、3年後施行となりました。これは経営側にとって厳しい内容であるだけに準備期間が必要な為ということでしょう。
◆派遺労働者を使用している時は準備を
今回の改正は以前に発生した派遣切りの多発や雇用の安定性に欠ける雇用形態の横行を抑制、防止する事業規制の面が強くなっています。不透明で低く不安定な待遇が長期になってしまわないよう派遣労働者の保護、安定雇用が織り込まれています。今回の改正では登録型派遣、製造業派遣の原則禁止は削除されましたが、今後の検討課題とされています。いずれにせよ派遣労働者を使用し、今回の改正点に該当するところがあれば、派遣労働者の使用の仕方について改正後の準備をすることが必要となるでしょう。
